Terms and Conditions

1. Eligibility

• You represent and warrant that you are at least 18 years of age.
• You confirm that all information provided by you is true, accurate, and complete.
• The Platform is intended solely for personal, non-commercial use unless expressly authorized in writing by the Company.

2. Account & Profile Responsibility

• The individual creating a profile ("Profile Owner") is solely responsible for all activity conducted through that profile.
• You are responsible for safeguarding your login credentials and for any actions taken using your account.
• The Company is not responsible for unauthorized access resulting from your failure to secure your account.

3. Acceptable Use

You agree not to:

• Use the Platform for commercial, promotional, or unlawful purposes.
• Misrepresent your identity or provide false information.
• Harass, abuse, defame, threaten, or harm other users.
• Upload malicious software, spam, or harmful content.

The Company reserves the sole and absolute right to suspend or terminate any account found violating its standards, policies, or values, with or without notice.

4. Content, Images, and Data

• You represent and warrant that you have full legal rights and consent to upload any images, data, or information submitted to the Platform.
• You agree not to upload content belonging to third parties without proper authorization.
• All content uploaded is shared on a common digital platform, and you understand the inherent risks of online interactions.
• The Company is not responsible for misuse of data or images by other users.
• You are solely responsible for determining what content you choose to share.

5. User Interactions & Verification

• The Company does not verify the identity, background, or claims of users.
• You acknowledge that it is your responsibility to independently verify the authenticity, intentions, and information of anyone you communicate with.
• The Company disclaims all liability arising from user interactions, communications, or relationships formed through the Platform.

6. Subscriptions, Payments & Cancellations

• All subscriptions are self-managed by the Profile Owner.
• It is your responsibility to cancel or disable your subscription if you wish to discontinue service.
• No refunds will be issued for any payment made for a current billing period.
• If a profile is deleted or disabled by the user, the current subscription period remains active and non-refundable; only the next renewal cycle will be discontinued.

7. Suspension & Termination

The Company reserves the right, at its sole discretion, to suspend, restrict, or terminate access to the Platform for:

• Violation of these Terms
• Malicious, fraudulent, or abusive behavior
• Activities deemed harmful to the Platform or its users

Any decision made by the Company regarding account suspension or termination shall be final and binding.

8. Intellectual Property

• All Platform content, design, software, branding, and intellectual property are owned by or licensed to the Company.
• You may not copy, reproduce, distribute, or use any content without prior written consent.

9. Disclaimer of Warranties

• The Platform is provided "AS IS" and "AS AVAILABLE".
• The Company makes no warranties regarding outcomes, matches, relationships, or compatibility.
• The Company disclaims all express or implied warranties, including fitness for a particular purpose.

10. Limitation of Liability

• To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or special damages.
• The Company shall not be responsible for loss of data, emotional distress, financial loss, or disputes arising between users.

11. Indemnification

You agree to indemnify and hold harmless PetraLux XP LLC, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising out of:

• Your use of the Platform
• Your violation of these Terms
• Your content or interactions with other users

12. Modifications to Terms

• The Company reserves the right to revise or update these Terms at any time.
• Updated Terms will be made available through a centralized location on the Platform.
• Continued use of the Platform after updates constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, USA.
• Any disputes, claims, or legal proceedings shall be brought exclusively in the courts located within the State of Colorado.

14. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding use of the Platform and supersede any prior agreements or understandings.

15. Acceptance

By clicking "Create Account," creating a profile, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
